Terms of Use

These Terms of Use ("Terms") govern your access to and use of the ClearSky platform and associated services provided by 79th Unit Limited. By accessing or using ClearSky, you agree to be bound by these Terms.

1. Acceptable Use

ClearSky is an open-source intelligence (OSINT) platform. You agree to use the platform only for lawful purposes and in compliance with all applicable laws and regulations. Specifically:

• You will only conduct lawful OSINT research using publicly available information.
• You will not use the platform for harassment, stalking, doxxing, or any unlawful surveillance.
• You will not attempt to gain unauthorised access to private systems, accounts, or data.
• You will not use the platform to process personal data in violation of the UK GDPR or Data Protection Act 2018.
• You will not upload, submit, or transmit any malicious code, malware, or harmful content.
• You will comply with any additional usage policies we publish from time to time.

We reserve the right to suspend or terminate your access immediately if you breach these terms.

2. Subscription Terms

Paid subscriptions are processed through Stripe. By subscribing, you agree to the following:

• Billing: Subscriptions are billed monthly or annually as selected at checkout. Prices are in GBP and exclusive of VAT where applicable.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access until then.
• Refunds: We offer a full refund within 14 days of your first subscription payment if you are not satisfied. After 14 days, no refunds are provided for the current billing period. Contact contact@79thunit.com for refund requests.
• Price Changes: We may adjust pricing with at least 30 days notice. Existing subscribers will be notified before any change takes effect.
• Free Trial: Trial periods (where offered) do not require a payment method. At the end of a trial, you must subscribe to continue using paid features.

3. Intellectual Property

ClearSky, including its name, logo, design, codebase, algorithms, data models, and all associated documentation, is the intellectual property of 79th Unit Limited. All rights are reserved.

• You may not copy, reproduce, distribute, or create derivative works of the platform without written permission.
• Data you submit or generate through the platform remains your property, subject to the licence you grant us to host and process it for the purposes of providing the service.
• We retain all rights to aggregated, anonymised analytics and platform improvements.

4. Limitation of Liability

To the fullest extent permitted by law:

• ClearSky is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not guarantee the accuracy, completeness, or reliability of any OSINT data or intelligence produced by the platform.
• 79th Unit Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
• Our total aggregate liability to you shall not exceed the amount you have paid us in the 12 months preceding the claim.
• Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

5. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

6. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the platform. Continued use of ClearSky after changes take effect constitutes acceptance of the revised Terms.
